Everyone is talking about the energy transformation and digitalization of industry, and the consequences of this are increasingly impacting German and international tax law. We would like to pick out and present a few aspects.

1.block: Tax policy
We provide a brief overview of what is happening in tax policy: What's going on in Berlin, What legislative projects are in the works? Which projects affect the engineering industry?
2.block: International tax law/ Mobile working abroad
Due to CoViD-19, but also due to advancing digitalization, assembly supervision, commissioning and maintenance in particular are increasingly being performed remotely, i.e. outside the project country and thus without a physical presence on the construction site. We present the tax treatment of such remote services.
Newspapers and the social media have repeatedly published reports stating that companies now want to, or will, offer their employees the option of mobile working. What is usually easy to implement in organizational terms turns into a legally complex matter upon closer inspection. In this exchange of experiences, we will deal with the risk of the representative permanent establishment.
In addition, the Federal Ministry of Finance published the updated Foreign Activities Decree (BMF letter of 31.10.1983, BStBl. I, 470) on 10.06.2022. The changes will apply from calendar year 2023 or for wage payment periods after December 31, 2022. We explain when an exemption is still possible under the Foreign Activities Decree.
3.block: Update on tax law
We provide a brief overview of what is happening in tax policy: What's happening in Berlin, What legislative projects are in the works? Which projects affect the mechanical engineering industry? For example, the German government has just passed the Annual Tax Act 2022 in the cabinet. Together with you, we will take a look at the relevant provisions in value-added tax and income tax. Furthermore, we explain and discuss with you the framework conditions of the new tax-free inflation compensation lump sum of 3,000 euros and the amended regulation on discounting liabilities and provisions.
4.block: Value added tax
After a long wait, the Federal Ministry of Finance has now also presented a draft update of the Application Decree 3.14 on series transactions. We take a look at the regulations and discuss the risks for typical case scenarios in mechanical engineering.
In May 2021, the Federal Ministry of Finance commented on the insurance tax liability for certain guarantee commitments. On Jan. 1, 2023, the transition period will expire. We will show the regulatory content and discuss with you how our industry will be affected.
5.block: Research allowance
The Research Allowance Act is now almost 3 years old. In a short exchange round, we want to hear your assessment: Who is using the new instrument? Who is not? And what are the reasons for the decision? What stumbling blocks are emerging in practice? What do we hear about this in the association from members?
In addition, we would like - as already announced - to enter into an intensive exchange of experiences with you. We have planned enough time for this at this event. What tax issues are you currently working on? Which topics are taken up in tax audits? In an open round, we would like to address your topics together. For this purpose, we ask you to bring a tax topic that is burning for you and present it to your colleagues.
The event is exclusively for VDMA member companies and free of charge for them.
