After a long wait, the government draft of the Whistleblower Protection Act (HinSchG) is now available, which implements the European Whistleblower Directive from 2019. The law is expected to come into force this year and will then apply in principle to companies with at least 50 employees. Companies with up to 249 employees will be granted a transition period until December 17, 2023 to introduce a whistleblower system. For larger companies, however, the establishment of a whistleblower system will become mandatory three months after the law comes into force. Failure to set up a whistleblower system can be sanctioned with a fine of up to 20,000 euros under the current draft law. High time, therefore, to start introducing a whistleblower system.

What can participants expect from the exchange of experiences? In the ninety-minute event, we will provide information on the legal requirements for setting up such a whistleblower system. In addition to the legal requirements for the design of an internal whistleblowing system, we will also address aspects of whistleblower protection under labor law and data protection law and relate the Whistleblower Protection Act to other special-law complaint mechanisms, for example under the Supply Chain Duty of Care Act (LkSG).
